Health Care Fraud
The United States federal system gives a provision in its constitution that caters for the unlawful acts in the health sector. This act is in place to curb the cases that may arise from individuals who may find it necessary to either wilfully or knowingly attempts to execute or executes an artifice or a scheme in the health provision sector in a fraudulent manner may be held responsible for the same in a court of law. Others in the category are the cases of frauds or defrauds in any health care program. It also covers the aspects of obtaining through fraudulent or false means and pretence, promises and representations of any cash or property that is owned by or is in the control or custody of a specific health care benefit program in the country.
According to the law, if such cases occur in connection with the payment or delivery of the items, services or the health care benefits, then the perpetrators shall be fined under the very title and may be imprisoned for 10 years or less or even both. All in all, if the violation causes serious injury to the body of the affected persons, then the person shall be fined and imprisoned for a period of 20 years or less or even both. This is according to section 1365 of this law. In case the violation causes the death of the person affected, then the perpetrators will be fined under this law plus a life imprisonment or both.
