Yes, this is a case of sexual harassment and it wasn’t only fun. If anything the case contains significant legal elements of a hostile environment. According to Boland, 2002, a hostile environment that contains legal elements are, if an employee is subject to unwelcome sexual harassment, if the harassment interferes with the employee’s performance reasonably, and if the harassment creates a hostile, offensive and an intimidating environment. In reference to Rosetta’s case, the sexual harassment which comprised of sexual innuendos and jokes (Shrier, 1996) qualify for unwelcome sexual harassment considering she never liked these jokes if anything they made her feel harassed and extremely uncomfortable. The harassment interfered with her performance considering she was mentally and psychologically worked up as this is evidenced when she confided in her friend on why she was in a somber mood. In fact the minute, she had to leave her work station to go and cry was a clear indication that the harassment interfered with her work. Finally, the sexual innuendos and jokes left Rosetta feeling intimidated, offended and harassed hence creating a hostile environment for her to a point she had to quit.
If I were Eva I would pass the same complaint to the supervisor’s superiors or go after Rosetta and file for lawsuit on sexual harassment. I would as well ask Rosetta to carry a hidden camera to record the incident before quitting the job. By going to the supervisor’s superiors it would create an alarm on what was going on at the plant station and that its working environment was no longer conducive for female workers. However, should the superiors assume the allegations I would ask Rosetta to reconsider coming back to the work station with the aim of collecting or gathering evidence on what was happening on the ground and thereafter, support her in filing a lawsuit against the plant. Even though both options have a 50/50 chance of success they should be worth pursuing considering the risks would be the supervisor’s superiors may assume the allegations or worse still have Eva lose the job and the second option, Rosetta may refuse the suggestion for the fear of the harassment escalating to something a lot worse than the sexual connotations. However, should any of the options be successful then there would be fewer cases of this kind of harassment especially in male dominated work stations.
