Employment-at-will Doctrine
Employment-at-will is an employment model that enables employers to offer jobs with no contracts. This employment model allows employers to terminate work contracts with employees without notice or explanation. It also allows employees to leave work for any reason without notifying the employer. Due to its nature, this work policy offers advantages to both the employer and employee but has some disadvantages.
One of the main advantages of this work strategy is that it offers great flexibility to both the employer and the employee (Hiley & Sass, 1985). The employer can terminate nonproductive employees at any time and hire new, suitable employees. As a result, an organization can fire unproductive workers at any time and hire new competent ones to improve its productivity. For the employee, the strategy offers a chance to seek a better opportunity if the present work environment is not conducive (Hiley & Sass, 1985). That means that an employee can seek a better-paying job or an organization with a better work environment. The employment-at-will doctrine is also beneficial since it enables employers to promote workers based on merit rather than seniority or contract rules. Therefore, due to this work model, an employee will always want to perform better to be promoted or paid better. In the process, the organization benefits from hard work and increased productivity.
While the employment-at-will doctrine offers much flexibility and many other advantages, it negatively impacts both employers and employees. For the employer, it makes it easy to fire but challenging to hire (Doyle, 2021).
