According to evidence produced at trial, suspects Travis and Gregory McMichael used a.357 Magnum revolver and a Remington shotgun to follow Mr. Arbery on February 23, 2020. William "Roddie" Bryan decided to assist the McMichaels in their quest even though he had no prior knowledge of Mr. Arbery. A four- to five-minute pursuit ensued between the three defendants and Mr. Arbery as they tried to encircle him with their cars. Mr. Arbery kept up a steady pace as they pursued him. There were other instances when he tried to run from the defendants but never spoke to them or made any threatening gesture. McMichael jumped out of his car and aimed a shotgun toward Mr. Arbery after he had changed routes many times while fleeing the defendants. Mr. Arbery was shot in the chest by Travis McMichael as he tried to defend himself by raising the weapon he had been shot with. After Mr. Arbery stumbled several steps, he fell face-first on the ground and died. Travis McMichael fired two additional shots (Department of Justice, 2022).
According to testimony given at trial, the defendants' racist opinions directed them to draw inferences and conclusions about Arbery that they would not have made if he were white. When Travis McMichael posted and texted friends about his wish for Black people to be wounded or murdered and his support for vigilante operations to apprehend or punish criminals in the past, it was clear that he had long connected Black people with crime. According to eyewitness testimony, Gregory McMichael made discriminatory insults to people he did not even know (Department of Justice, 2022.

An act's hate may be proven by a third party, a witness, or a police officer.
