Statutory nuisance as contained in Act 1990 section 79, was passed by Act of parliament and focused on the odour pollutants emitted into the air and negatively impact human being and their health (Battersby, and Pointing, 2019, 92). Human beings have the right to be protected from any pollution substances. To determine whether a business premise is acting according to the Act, data has to be collected and conclusion made. The business is then prosecuted if found to qualify as a statutory nuisance.
However, for the business to be prosecuted, there must be evidence that the business acted in a manner that negatively interferes with the environment (Battersby and Pointing, 2019, 173).
