Organ Market.
The National Organ Transplantation Act of 1984 outlaws the sale of organs for transplantation (Elias et al.). The prohibition creates a price ceiling at zero dollars for organs such as kidneys. This price ceiling leads to a mismatch between demand and supply, resulting in organ shortage despite the growing demand (Levy,402). Data from the Health Resources and Services Administration shows that over 109,000 patients were awaiting transplant as of September 2020, most of whom suffer from renal failure. Moreover, in 2019 only 39,718 organ transplants were performed, while 17 people die each day while awaiting organ transplant (Health Resources & Services Administration). This data shows a widening gap between demand and supply, leading to a public health problem (Levy,402). Furthermore, the organ shortage has led to organ trafficking and transplant tourism (Levy,404). Therefore, it is clear that the current legal frameworks are inadequate, and there is a need to implement new measures such as a free organ market to combat the challenging reality.
