The case of George Jones, the GMFC and the labor union is arbitralable. The rationale for this decision is that despite of the existence of the strict policy against fighting, the company has overlooked several crucial facts. One of these facts is the impeccable record that Jones has having worked at GMFC for four years. The other fact is the information provided by Cronholm that Johnson had been racially abusing Jones despite Jones asking him to stop.
The union demands reinstatement with full back pay for Jones, I would award Jones full reinstatement without back pay. This is because despite his claims of being racially abused by Johnson, there could have been other ways to solve the issue without involving fighting. The back pay is therefore ignored as a punishment for his action. However, the reinstatement is because the company there are no policies to protect workers against racism, it needs to develop policies against racism at the workplace to avoid such incidences.
