Emergence
The zero tolerance policy enacted by local and state education agencies serve as responses to the rising tide of violence and drugs that have prevalently invaded public schools in recent years. In fact, zero tolerance laws were comprehensively included per provision in the No Child Left Behind Act that provides that students need to be expelled for having guns in learning institutions, but not necessarily for bring firearms to school. In addition, the act empowers local district schools to place more vigilant policies on their students with the exception of when school sponsored gun clubs require their students to possess guns for them to participate (Schoonover, 2009).
Formulation
There is no exact date that the zero tolerance policy was formulated, however, despite the fact that the Gun Free Schools Act never became federal until 1994, a good number of states had already passed the zero tolerance laws to expel students for the offense of possessing firearm and showing disorderly conduct. At the time zero tolerance first entered the vernacular of federal legislators, the word was understood to be the goal of enacting a zero tolerance law that was aimed at producing gun free learning institutions(Schoonover, 2009).
Implementation
Since zero tolerance policy was an improvement to the Gun Free Schools Act, implementation of the policy was easy as the Gun Free Schools Act allowed for the expansion of the law transforming it to what it did not only mean from state to state but also to what it means from district to district. Also, local district schools implemented the policy in order to get the federal money given to states that adhere to federal laws (Alexander & Alexander, 2011).
Evaluation
After implementation of the zero tolerance policy, people evaluated the law from all angles; something that raised criticisms from a variety of people. For example, there are cases that challenge the policy ranging across a wide breadth of constitutional protection. The range include equal protection, speech and vagueness of the policy. The challenges led to the court upholding the policy in case the policy comport with procedural due process needs. The policy was as well criticized for being tough also on parents (Alexander & Alexander, 2011).
The zero tolerance law is not standard, and it was heavily criticized for that because a zero tolerance in one district may differ completely from another one in the neighboring district. This brings confusion in students that transfer from one local district to the other.
The future of Zero Tolerance Law
Since one policy of the law may differ in two different local school districts, there is high chances that the law shall be amended in order to be standard and uniform. The amendment shall as a way of eradicating the discrimination brought about by the differences of the law in different school districts.
What schools should do
Schools should call for the amendment of the law in order to bring about uniformity in the policies of the law. In addition, schools need to comply with the zero tolerance policy in order to facilitate gun and drug control in schools.
