Abstract
This paper aims to embark on the Special Education Law’s principle of nondiscriminatory evaluation when undertaking an assessment carried out by the school district. Several school districts should follow several guidelines to ensure that there is transparency and honesty when carrying outplacement assessments meant to benefit students with special needs to receive Free and Appropriate Public Education (FAPE). Some laws govern individuals with a disability which are enshrined under the Individuals with Disability Education Act (IDEA). IDEA helps develop placement tools to ensure that children with disabilities are not left out due to misidentification, cultural, and racial segregation to promote equity and equality in coming up with an appropriate school placement criterion.
