Introduction
The 14th Amendment in the US constitution serves primarily to shield the blacks from inequality after the civil war. According to the 14th Amendment, it is unlawful for states to deprive persons of life, property, and liberty unfairly. The law also bars the states from denial of equal protection of the law. The Amendment sought to solve the issue of inequality through granting the right of citizenship to all people born in US soil, including freed slaves. According to Galanter (1974), various changes should apply to the existing laws that would allow tax and transfer systems as the only mechanisms that can address the issue of inequality. However, most researchers and scholars agree that establishing viable tax systems was the most effective way to address inequality as compared to making use of the existing legal order.
Another way to avoid economic inequality is through the argument of double distortion. The notion of dual distortion states that the legal rules that seek to redistribute income only serve to add to the burden of the existing distortions in the tax regime. To this end, therefore, the juridic principle of thought states that a mix of legal statutes and a vibrant tax regime is used to deal with the problems of inequality.
