The paper primarily focused on analyzing the scope of the fourth amendment. It constituted common questions that relate to the fourth amendment. 1 To whom does the 4th amendment apply?
The fourth amendment applies to anyone as long as they are under the protection of the constitution. The things the individuals get protected from include unreasonable seizures and searches from any government member. Despite this, the fourth amendment does not guarantee protection to all seizures and searches, especially those not deemed reasonable under the law.
2 What must a person claim to have a valid 4th amendment challenge?
First, the person must be able to show proof of authority. In this case, the police officer should at least reveal the presence of weapons and handcuffs.
