(2) to spread information and awareness about the effects of discrimination on LGBTI older adults, and (3) recommend solutions for handling the problem facing LGBTI older adults within Kisumu. 2 Research Proposal 2.1 Research aims This research investigates the psychosocial obstacles that LGBTI older adults living in Kisumu face, whether they choose to come out and express their sexuality, and the consequences of these challenges. 2.2 Project description Many LGBTI older adults do not have low self-esteem and are dissatisfied with their societal stigmatization status. Harassment against LGBTI older adults is a widespread occurrence across the world. Compared to heterosexual persons, LGBTI older adults are ten times more likely to encounter discrimination based on their sexual orientation than heterosexual people (Mesa Romero 2019). Mistreatment manifests itself in various ways, including physical violence, rough treatment, insults, and threats. For many LGBTI older adults, prejudice can be found everywhere, including at home, which lasts their entire lives. Mhiripiri & Moyo (2016), there is a negative trend from various families when their children come out as LGBTI. Caucus (2021), LGBTI children account for 40% of all homeless teens, with family rejection as the primary reason for their plight. Ayuditha (2018), LGBTI older adults who experience family rejection are likelier to be sad, have tried suicide, or use illegal drugs. They are growing up in a community where heterosexual marriage is generally portrayed as the only accepted inclination, which is challenging for the LGBTI community. LGBTI older adults are considered aberrant and encounter various obstacles in life. Therefore, most of the signs in this research relate to psychosocial issues that LGBTI older adults face, whether to remain in secret or come out and express their sexual orientation. 2.3 Significance of research * The research has significance to the LGBTI older adults, as they will be aware of the acceptance of others and the circumstances that can contribute to the willingness of others in society toward them. * Using the findings of this research, counselors will be better able to understand the origins of psychosocial issues affecting LGBTI and how to prevent and manage emotional problems among LGBTI older adults * The research will help the community realize that LGBTI is ordinary humans who deserve to be treated fairly like any other individual. This will be accomplished by creating awareness. 2.3.1 Research Question Does the idea of coming out as an LGBTI older adult cause more anxiety than continuing to hide actual sexual orientation? 2.3.2 Hypothesis Not coming out as a member of the LGBTI causes more anxiety than expressing true sexual identity. The factor of LGBTI older adults not expressing themselves is more damaging to health than coming out and being rejected by society. 2.4 Significance to law/policy/services 2.4.1 Domestic Human Rights Considerations: Kenya's 2010 Constitution Kenya had already enshrined LGBTI rights in Kenya's 2010 constitution, and Kenyan LGBTI persons are entitled to, among other things, the right to: * Life (Art. 26) * Privacy (Art. 31) * Education (Art. 43[1][f]) * Human dignity (Art. 28) * Freedom of expression (Art. 33) * Freedom of association (Art. 36) * Freedom and security of the person (Art. 29) * Access to justice (Art. 48) * Access to information (Art. 35) * Assembly, demonstration, picketing, and petition (Art. 37) * Equality and freedom from discrimination (Art. 27) * The right to health services, including reproductive healthcare (Art. 43[1][a]) While the Kenyan constitution does not explicitly safeguard the right to nondiscrimination based on sexual orientation, judicial interpretation could establish LGBTI persons as a constitutionally protected group. Article 27 (4) of Kenya's constitution guarantees that "the State shall not discriminate directly or indirectly against any person on any ground." The Kenyan Penal Code directly discriminates against LGBTI populations based on sexual orientation. Criminalization contributes to indirect discrimination against LGBTI persons by state officials and third parties. The Kenyan constitution bolsters LGBTI persons' human rights claims. Kenya's constitution is distinct in protecting and recognizing human rights norms in international law. Article 25 states that "the general rules of international law shall form part of the law of Kenya"; Article 26 guarantees that "any treaty or convention ratified by Kenya shall form part of the law of Kenya under this constitution." 2.4.2 International Human Rights Considerations There exist a variety of sources of law that protect LGBTI persons' human rights. These sources include protections in international treaties, as interpreted by U.N. treaty-monitoring bodies. The International Covenant on Economic, Social, and Cultural Rights (I.C.E.S.C.R.), the International Covenant on Civil and Political Rights (ICCPR), and the Universal Declaration of Human Rights (U.D.H.R.) (Mesa Romero 2019). The U.D.H.R. provides a solid basis for rights protections found in the ICCPR and the I.C.E.S.C.R. As previously mentioned, the Kenyan constitution protects those human rights norms evoked by international law. The Statute of the International Court of Justice defines customary international law in Article 38(1) (b) as "evidence of a general practice accepted as law." 2.4.3 LGBTI Persons' Rights as International Human Rights The U.N. Office for the High Commissioner for Human Rights (U.N.O.H.C.H.R.) 2013 unveiled its "Free and Equal" campaign, the most extensive global public education on LGBTI people's human rights in international law (Mesa Romero 2019). "Free and Equal" acquired its name from Article 1 of the U.D.H.R.: "All human beings are born free and equal in dignity and human rights." The campaign follows almost 20 years of international recognition for equality based on sexual orientation and gender identity (S.O.G.I.) (Mhiripiri & Moyo 2016). Since 1994, U.N. institutions and interpreters of international law have confirmed their explicit support for LGBTI persons' human rights (Mhiripiri & Moyo 2016). U.N. human rights treaty-monitoring bodies and Special Procedures (including Special Rapporteurs) have declared that international human rights norms support equality for LGBTI persons (Caucus 2021). In June 2011, the U.N.H.R.C. adopted Resolution 17/19, which conveyed "grave concern" at discrimination and violence against LGBTI (Ayuditha 2018). 2.5 Advancing Program Goals 2.5.1 LGBT members The research has significance to the LGBTI older adults, as they will be aware of the acceptance of others and the circumstances that can contribute to the willingness of others in society toward them. 2.5.2 Counselors Using the findings of this research, counselors will be better able to understand the origins of psychosocial issue...
