INTRODUCTION
Transition justice is a contested and evolving process, which emerged in the 1990s. it is understood as a set of practices, mechanisms and concerns that arise following a period of conflict civil strife or repression, and aimed directly at confronting and dealing with post violations of human rights and humanitarian law (Javier, 2006).
The TJRC in Kenya was conceived as part of wider transitional justice instruments, put in place to address impunity while firmly entrenching the country on the road to democratic consolidation. TJRC was a process in response to what came to be known as Agenda four postulates that the disputed election only acted as a trigger: deeply underlying issues caused the post –election violence. The root causes included unemployment, poverty, unequal distribution of resources, perceptions of historical injustices and marginalization. To address these challenges, Agenda four proposed several institutional changes including: undertaking constitutional, legal and institutional reforms; tackling poverty and inequality; consolidating national cohesion and unity; and carrying out land reforms, among other changes. This paper will explore the process and outcomes and challenges by the Kenyan Truth and Reconciliation process by looking at the nature of Kenyan conflict, areas that the commission was addressing and finally the challenges encountered by the commission.
