Why Alimony Could be the Problem
Divorce is one of the most talked about topics in legal, religious and intellectual circles, largely because it affects more than the individual lives of the divorcing couple; it disrupts the family, interrupts the children’s social and academic life, as well as severs kinship ties. However, the way in which most divorces are settled, that is through payment of alimony and paying child support, could be one of the factors that encourage the phenomenon. Accordingly, this paper calls for an amendment of divorce laws to allow divorcing couples to only share wealth they created while married.
In America where child support and alimony laws are well enforced, it is estimated that over 50 percent of all marriages end in divorce (Plunkett, 2014). Statistics also indicate that divorce rates tend to be higher among the rich compared to couples in the lower class. Certainly, it is not pure coincidence that divorce is prevalent in a society that is not only as materialistic as the U.S., but also with effective family laws that guarantee the divorce-seeking partner, usually the wife, a chunk of the family wealth, the fact that she did not contribute to its creation notwithstanding.
In light of this situation, it is reasonable to argue that the assurance of alimony and child support is a major factor that encourages wives to seek divorce at the slightest offense. Consequently, it is necessary to amend the existing laws on divorce to ensure that partners who seek divorce do so under justifiable grounds, and are not exploiting the legal system to make a claim on the man’s wealth. While paying child support is unquestionable, and indeed a responsibility that any man worth his loins should not wait for a court order to fulfill, it is unfair for one to surrender part of his wealth to someone who, perhaps, her only reason for getting into the marriage in the first place was money.
