Driving under the influence (DUI)
Driving under the influence (DUI) is the act of operating a vehicle after consuming drugs, mostly alcohol, or any other drugs that cause intoxication and impairs judgment (US Legal). In the majority of the countries, driving while drunk is a criminal offense. If one is in physical control of a vehicle or drives while they are under the influence of alcoholic beverages or any controlled chemical substance to the point that their mental faculty is impaired, then they are guilty of a DUI. The culpability of an individual is determined with the blood alcohol level (BAC) which is set legally. In case one surpasses the legal limit of BAC according to the laws of the state, they are guilty of DUI (US Legal). This paper tries to explain cases that a DUI can be charged as a felony according to traffic laws and regulations.
DUI is charged as a misdemeanor in most of the cases. However, under several specifications, a DUI can be charged as a felony. This also depends on the laws and regulations of states. The first specification is the case that one has the fourth DUI in under ten years. It is a discretionary charge if the prosecution opts to charge one with a misdemeanor in this instance.
