Texas Government’s Handling of Abortion Law Amidst the COVID-19 Pandemic Raises Questions of Adherence to the Rule of Law
Ever since the COVID-19 pandemic commenced and threw the world into turmoil, policymakers have been facing a conflict regarding how to handle its spread without necessarily trading on individuals’ rights as espoused by the Constitution. Texas Governor Greg Abbott prohibited all surgical abortions, promptly followed by medical abortions, during the entire course of the pandemic. Despite a successful appeal by concerned lobbyist groups that the directive was unconstitutional and ill-timed, the state maintains its stance and, because the Governor’s executive decree supersedes those of the municipal and the city, it holds. Yet, he permitted religious gatherings as an "essential service," placing public health at considerable risk of contamination because of a lack of social distancing. The COVID-19 pandemic has been used by the conservative government to trudge on abortion rights.
