When Miss Yolanda Pinellas approached the doctor, she expected medical treatment from all the knowledge and skill that the doctor had so that she can feel relieved from her condition. Her relationship with the doctor assumes that of a contract that would bear all the elements of the tort. The doctor owed her certain duties, and a breach of any of those duties creates a course of action for negligence against him. Such duties include obtaining prior informed consent from Miss Pinellas before carrying out any diagnostic tests on her or beginning any therapeutic course of management. Secondly, is that she hoped that the hospital and the stuff would not bring any manner of harm to her either because of negligence, recklessness, or careless attitude of the staff. As for the practitioner, he may not be in a position to save her at all the times but that he used his special knowledge and skill in all appropriate manner considering that she entrusted her life to her CITATION MSP09 \l 1033 (Pandit, 2009).
